DH&D partner Russ Hewit was part of the lead team representing Hoffman-La Roche, Inc. (Roche) in its successful challenge to plaintiffs’ claims that Accutane (generic name isotretinoin) causes Crohn’s disease. On February 20, 2015, following a 9 day Kemp hearing, Judge Nelson Johnson issued his ruling in the Accutane MultiCounty Litigation pending in Atlantic County, barring plaintiffs’ experts from offering an opinion that Accutane causes Crohn’s disease and finding that the testimony of plaintiffs’ experts fell “far short of ‘sound, adequately-founded scientific methodology . . . of the type reasonably relied upon by experts in the scientific field.'” Judge Johnson described plaintiffs’ presentation as a “ruse” and “sophistry.” The decision, In Re: Accutane, Civil Action No. 271 (MCL) (Superior Court of NJ, Atlantic County, February 20, 2015) is available here and on the NJ Judiciary website.
There are approximately 7500 cases pending against Roche in the In Re: Accutane Multicounty Litigation and it is estimated that this ruling will result in the dismissal of over 2500 cases.

Craig A. Domalewski will be a speaker at the 2015 Annual Redevelopment Law Institute. Mr. Domalewski will participate on a panel which will discuss the future of Atlantic City redevelopment amid all of the changes taking place. The Open Public Records Act (OPRA) is getting expensive for New Jersey’s municipalities and agencies. The following are just a few of the more egregious examples.
A court-appointed fact finder recommended that a judge order Raritan Borough to pay Gannett New Jersey media company a record $542,000 in legal fees as a result of an OPRA lawsuit.
A Morris County woman received $150,000 in a settlement to end litigation that included her claims that Mount Olive Township did not turn over public documents to her under OPRA. (more…)
